So you have had a wreck and in your mind are all the horror stories of uninsured motorists. Before you even get out of your car to check the damage you are probably wondering if you are going to have to sue to recover for the damages. Luckily, you find out the other driver has insurance. But what can you do to make sure that your rights are protected as, even if you file an insurance claim?

Here are some tips that can keep you out of court and protect your rights:

  • Call your insurance agent as soon as possible. If you are severely injured, this may not happen for awhile.
  • Don’t sign anything or allow yourself to be recorded until you know what is covered under your policy. You could find yourself in a situation where you will be denied compensation because of something you said under duress.
  • Try to remember as much about the accident as possible. The insurance company will ask you many questions—sometimes over and over—about what happened. If you are coherent enough to write it down, do. Also make notes with about any conversations you have with your insurance company.
  • Make sure pictures are taken. These pictures should not only include the car but any injuries you have as well. Pictures can speak louder than words and prove your case better.
  • Don’t be dishonest about anything. If you end up in court, your dishonesty can come back to haunt you or you could be denied compensation if you lie.
  • Keep detailed financial records. You can be reimbursed for expenses spent while recovering from the accident.
  • You can get a second opinion! That includes requests for an estimate on damages from another repair shop besides the one your insurance company recommends.
  • Be wary if you are offered a check for a “final payment.” Don’t accept it until you are sure it is enough to cover your expenses.

Finally, even if you have a good relationship with your insurance agent, consult an attorney. Many attorneys offer free consultations and if you do have a case, they will work on a contingency basis. In other words, they don’t get paid unless you get a settlement. Make sure you and your family are taken care of if you are in a car accident, no matter how minor it may seem.

Don’t forget you have been paying premiums for years. According to the Insurance Information Institute , the average premiums range from $1,164 to $634 annually depending on where you live. You shouldn’t have to fight your insurance company to be compensated.
