Car Accidents And Insurance Claims

Car accidents and insurance claims are almost synonymous with each other. In more cases than not, if a person has been involved in a car accident they will also file an accident claim. An accident claim is a way for a person(s) to recoup any financial losses they may have sustained as a result of the accident. Car accident claims are often filed by both parties that were involved in the accident, and depending on the laws of their state, they may or may not receive compensation. If either party feels that they are wrongly being held responsible for resulting damages they have the right to file a car accident lawsuit. A court will hear both parties' sides, and consider the facts before rendering a decision.

Fast Facts

    • A no-fault state does not hold either party liable for the accident, but instead requires that both parties seek compensation from their respective auto insurance carriers.
    • A tort state requires the one or the other parties be held liable for resulting damages from a car accident.
