A Bronx Jury Awarded $800,000 To Ljuca Ivezic For Injuries Suffered In A Bronx, New York Car Accident


The New York State Supreme Court case  stems from a June 5, 2001 incident on the Bronx River Parkway. Mr. Ivezic, an Albanian immigrant, had finished work for the day and was riding home as a passenger in a van. At the same time, Mr. Joseph Sansone, driving a Ford Van, speeded south in the third lane of the parkway. Mr. Sansone came upon a truck owned and operated by the Tully Construction Corporation, whose workers were removing traffic signs from the center median. According to testimony at the trial, as Mr. Sansone approached, the Tully Construction vehicle lurched away from the center divider. The car and truck collided and sent Mr. Sansone"s vehicle careening into the side of the van in which Mr. Ivezic rode. Mr. Ivezic suffered significant injuries to his back and neck.

Attorney Carol L. Schlitt, the trial lawyer for Mr. Ivezic, said, "The car driver bore responsibility for not avoiding the construction truck. However, the construction company also bore responsibility for acting in a manner contrary to the company"s own safety requirements and contrary to New York State vehicle and traffic laws." The construction workers were picking up warning signs from the northbound lane while traveling in the southbound lane – a direct contradiction of safety requirements. "They wanted to get home a little early so they cut corners, but those cut corners led to Mr. Ivezic"s injuries."
